General terms and conditions

Scope of Services MD biro d.o.o. (the “Agency”) provides services for the sale, purchase, rental, or management of real estate properties located in Croatia, Europe. The Agency’s services include, but are not limited to, property search, property valuation, property listing, negotiation, and documentation.

Contract Formation The Agency’s services are provided upon request by the client (the “Client”) and are subject to a written agreement (the “Agreement”) signed by both parties. The Agreement sets forth the terms and conditions of the services to be provided by the Agency to the Client.

Obligations of the Agency The Agency agrees to provide its services with the skill, care, and diligence that may be reasonably expected from a professional real estate agency. The Agency shall act in the best interests of the Client and shall keep the Client informed of any developments in connection with the services provided.

Obligations of the Client The Client agrees to provide accurate and complete information about the real estate property, including but not limited to, the property’s location, size, condition, and any other relevant information. The Client also agrees to provide the Agency with all necessary documents related to the property, such as deeds, certificates, and permits. The Client shall promptly notify the Agency of any changes in the property’s status or any other information that may affect the Agency’s services.

Fees and Expenses The Agency’s fees for its services shall be agreed upon in the Agreement. The fees shall be paid by the Client in accordance with the payment terms specified in the Agreement. The Client shall also reimburse the Agency for any expenses incurred by the Agency in connection with the services provided, such as advertising costs, travel expenses, and fees for third-party services if agreed.

Confidentiality The Agency shall keep confidential all information provided by the Client or obtained by the Agency in connection with the services provided. The Agency shall not disclose such information to any third party without the prior written consent of the Client, unless required by law or stated in the Agency’s Privacy policy.

Liability and Indemnification The Agency shall not be liable for any loss, damage, or injury arising from the services provided, unless caused by the Agency’s willful misconduct or gross negligence. The Client shall indemnify and hold the Agency harmless from any and all claims, damages, and expenses arising from any breach of the Agreement or any other act or omission by the Client.

Termination Either party may terminate the Agreement at any time upon written notice to the other party. In the event of termination, the Client shall pay the Agency for the services provided up to the date of termination.

Governing Law and Jurisdiction The Agreement shall be governed by and construed in accordance with the laws of the Republic of Croatia. Any dispute arising from or related to the Agreement shall be resolved by the Croatian courts.

Miscellaneous The Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the services to be provided by the Agency. The Agreement may not be amended or modified except in writing signed by both parties. The failure of either party to enforce any provision of the Agreement shall not be construed as a waiver of such provision or of the right to enforce such provision.
